http://ift.tt/eA8V8J By Innocent Anaba lagos—A Federal High  Court sitting in Lagos, yesterday, held that a prosecution witness cannot give opinion evidence in the trial of a former Governor of Abia State,  Dr Orji Uzor Kalu. The trial judge, Justice Mohammed Idris reached the conclusion in his ruling on an objection raised by Kalu’s lawyer, Mr Awa Kalu, SAN, to the evidence of the witness. The Economic and Financial Crimes Commission, EFCC, had on October 31, 2016, preferred a 34 count charges bordering on N3.2 billion fraud against Kalu, his former commissioner for Finance, Ude Udeogo and a company, Slok Nig. Ltd. The accused had pleaded not guilty to the charges. At the hearing in the matter on Monday, the prosecutor, Mr Rotimi Jacobs, SAN, had led its fourth witness, Mr Romanus Madu,  a Permanent Secretary  at the Government House of Abia State, in evidence in chief. Other appellants in the suit are: BNP Paribas Securities Corp., Mr Hermant Patel and Seplat Petroleum Development Company Limited. Chevron, in the appeal, is challenging the judgment of a Lagos Federal High Court, which assumed jurisdiction to entertain a suit on the divestment of Chevron’s interest in Oil Mining Licenses 52, 53 and 55. When the matter came up, yesterday, counsel to Chevron and BNP Paribas Securities Corp., Ashimiyu Ayodeji, told the court about an application for stay of proceedings filed on May 28, 2014. He also told the court that his wife died from shock few weeks after the incident. Kehinde, who is the elder brother of Isikiru Oladeinde, the deceased mechanic, testified that his colleague caused his untimely death by hitting him several times with the plank at Ashade Market, Agege. According to him, the accused and the deceased became embroiled in an argument on April 12, 2014, and in the process, he hit Isikiru on the hand with the plank. Nwizu, who is the Managing Director of Bendusco Nigeria Limited, Onitsha, is being prosecuted before Justice I. B. Gafai on a four-count charge. The charges border on manufacturing, storing and distribution of substandard tooth brush, breaking of seal order and non-compliance with Standard Organisation of Nigeria, SON’s regulations.
